Structure, principles of formation and amount of remuneration of the Head of the State Expert Center of the Ministry of Health of Ukraine

In accordance with subparagraph "ґ" of paragraph 18 of part two of Article 5 of the Law of Ukraine "On the Management of State-Owned Property" (hereinafter, the Law), in managing state-owned property, the Cabinet of Ministers of Ukraine determines the procedure for remuneration and compensation of the heads of state enterprises.

In accordance with part one of Article 14 of the Law, by decision of the supervisory board (if established) or of the body authorized to manage state-owned property, the heads of state unitary enterprises and business entities in whose authorized capital more than 50 percent of shares (stakes) belong to the state may be paid remuneration based on the financial and economic performance of those state unitary enterprises or business entities. The procedure for determining the amount of remuneration and the terms of its payment are determined by the Cabinet of Ministers of Ukraine.

On this basis, the remuneration of the head of the Center is determined in accordance with the resolution of the Cabinet of Ministers of Ukraine of 19.05.1999 "On the Terms and Amounts of Remuneration of Heads of Enterprises Owned by the State or Municipalities and of Associations of State Enterprises" (as amended) (hereinafter – the Resolution). In accordance with paragraph 1 of the Resolution, heads of central executive authorities who conclude contracts with heads of state-owned enterprises have the right to establish exceptional terms of remuneration.

Thus, the remuneration of the head of the State Expert Center of the Ministry of Health of Ukraine (hereinafter – the Center) is determined in accordance with the terms of the contract.

In addition, the MoH is also entitled to determine incentive payments to the head of the Center in accordance with the terms of the contract.
